MY STEAM TEAM, LLC — TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the My Steam Team, LLC website, including any online store, checkout flow, digital content, downloadable materials, and related pages (collectively, the “Site”), and any products, kits, components, digital materials, classes, camps, workshops, parties, events, demonstrations, or other services we offer (collectively, the “Services”). The Site and Services are provided by My Steam Team, LLC (“My Steam Team,” “Company,” “we,” “our,” or “us”).

PLEASE READ CAREFULLY. By accessing or using the Site or Services, creating an account, making a purchase, clicking an “I Agree” button, checking a required waiver box, or otherwise indicating acceptance, you acknowledge and agree that:

1. you have read and understand these Terms;
2. you agree to be bound by them; and
3. you have the legal authority to enter into these Terms on behalf of yourself and any minor participant.

I. ELIGIBILITY; MINORS; PARENT / GUARDIAN RESPONSIBILITY

A. Minimum Age

You must be at least thirteen (13) years old to access and use the Site.

B. Users Under 18

If you are between thirteen (13) and eighteen (18) years old (or otherwise under the age of majority where you live), you may use the Site only with the permission and supervision of your parent or legal guardian, and you represent that your parent or guardian has reviewed and agreed to these Terms.

C. Accounts and Purchases

You must be at least eighteen (18) years old to create an account, place orders, submit payment information, sign waivers, or enter into transactions.

D. Parent / Guardian Responsibility

If you permit a minor to use the Site, Products, or Services, you agree that you are solely responsible for the minor’s supervision, conduct, safety, and compliance with these Terms and all instructions and warnings. You agree to these Terms on behalf of yourself and the minor.

II. ACCESS TO THE SITE AND SERVICES

A. Accounts

If account registration is offered, you agree to provide accurate information and to maintain the confidentiality of your login credentials. You are responsible for all activity under your account.

B. License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes only, subject to these Terms.

C. Restrictions

You may not misuse the Site or Services, including by scraping, reverse engineering, harvesting data, interfering with security, uploading malware, impersonating others, or using the Site for unlawful purposes.

D. Third-Party Offerings

Links to third-party websites or services are provided for convenience only. We do not control or endorse Third-Party Offerings and are not responsible for them.

E. Ownership and Feedback

All Site content and intellectual property are owned by My Steam Team or its licensors. Any feedback you submit may be used by us without restriction or compensation.

III. CONTENT AND INTELLECTUAL PROPERTY

All text, images, videos, lesson plans, instructions, templates, downloads, software, and other materials on the Site (“Content”) are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, or exploit Content.

IV. USER CONTENT

You are solely responsible for any content you submit (“User Content”). You grant My Steam Team, LLC a worldwide, royalty-free license to use User Content for operating and marketing the Site and Services. We may remove User Content that violates these Terms.

V. ONLINE STORE; PRODUCTS; ORDERS

(No subscriptions unless expressly stated at checkout)

A. Products

We may offer physical kits, components, tools, supplies, printed materials, and/or digital goods (“Products”).

B. Orders and Pricing

Orders are offers to purchase and may be accepted or rejected at our discretion. Prices and availability may change without notice. Errors may result in cancellation and refund of amounts paid.

C. Payment; Shipping; Returns

You agree to pay all applicable prices, taxes, and shipping fees. Shipping times are estimates. Returns and refunds are governed by policies presented at checkout or on the Site.

VI. SAFETY, ASSUMPTION OF RISK, RELEASE OF LIABILITY

A. Safety Warning: Adult Supervision Required

Hands-on STEAM activities involve inherent risks. Depending on the Product or activity, risks may include choking hazards, sharp objects, cutting tools, projectiles, burns, heat, electricity, batteries, magnets, chemicals (including household ingredients), allergens, slips, falls, and property damage.

You agree to follow all instructions and warnings and to provide appropriate adult supervision.

B. Age Restrictions

Unless expressly labeled otherwise, Products may contain small parts and are not intended for children under three (3).

C. Assumption of Risk

You knowingly and voluntarily assume all risks associated with use of the Site, Products, and participation in Services and activities, for yourself and any minor participant.

D. Release and Waiver (Adults)

To the fullest extent permitted by law, you release and waive all claims against My Steam Team, LLC and its owners, officers, employees, contractors, agents, affiliates, and successors (“Released Parties”) arising from or related to the Site, Products, Services, or activities, including claims based on ordinary negligence.

E. Parental Consent; Minor Release; Indemnity

If you are a parent or legal guardian of a minor participant, you:

• consent to the minor’s participation;
• agree to these Terms on the minor’s behalf; and
• release claims you may have as a parent or guardian.

To the fullest extent permitted by law, you also agree to defend, indemnify, and hold harmless the Released Parties from claims arising out of the minor’s participation, except where prohibited by law or caused by gross negligence or willful misconduct.

F. California Civil Code § 1542 Waiver

If you are a California resident, you waive California Civil Code § 1542, which states that a general release does not extend to unknown claims.

G. Disclaimers

THE SITE, CONTENT, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

H. Limitation of Liability

To the fullest extent permitted by law, the Released Parties shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the greater of $50 or the amount you paid to us for the applicable Product or Service in the six (6) months preceding the claim.

I. Educational Demonstrations; No Substitute for Parental Judgment or Supervision

All activities, lessons, experiments, demonstrations, videos, and related content provided through the Site, Products, or Services are offered for educational and informational purposes only. They are intended to demonstrate general STEAM concepts and ideas and are not a substitute for parental judgment, instruction, supervision, or common-sense safety practices.

You acknowledge and agree that:

• Children may differ in skill level, maturity, coordination, and risk awareness;
• Parents or legal guardians are solely responsible for determining whether an activity is appropriate for a particular child;
• Parents or legal guardians must assess the safety of the environment, materials, tools, and equipment used; and
• Continuous adult supervision is required where appropriate, regardless of whether supervision is referenced in any specific activity or video.

For avoidance of doubt, any videos linked from the Site including videos hosted on third-party platforms such as YouTube are provided solely as non-exhaustive visual demonstrations of activity steps. Videos may omit safety precautions, preparatory steps, or modifications necessary for a particular participant, environment, or circumstance, and must not be relied upon as complete or real-time instructions.

My Steam Team, LLC does not provide professional, childcare, medical, or safety advice, and makes no representations that any activity is safe or appropriate for all children, settings, or circumstances.

J. Stop-If-Unsafe Requirement

You agree to immediately stop any activity if:

• conditions appear unsafe or change during the activity;
• instructions are unclear, incomplete, or not fully understood;
• materials, tools, or equipment appear damaged, malfunctioning, or unsuitable;
• a participant appears uncomfortable, distressed, fatigued, frightened, or otherwise at risk; or
• you are uncertain about the safe continuation of the activity for any reason.

You acknowledge that no activity is mandatory, and that choosing to stop, modify, or not attempt an activity is an expected and appropriate exercise of parental or adult judgment.

This obligation applies equally to activities depicted in videos. If a video appears inconsistent with written instructions, omits safety steps, or does not reflect your actual environment or participants, you agree to stop, modify, or not attempt the activity.

Failure to stop an activity under unsafe or uncertain conditions is solely the responsibility of the supervising adult or participant and constitutes an assumption of risk under these Terms.

VII. TERM AND TERMINATION

These Terms are effective upon use of the Site. We may suspend or terminate access at any time. Provisions intended to survive termination shall survive.

IX. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER

A. Arbitration Agreement

Any dispute arising out of or relating to these Terms, the Site, Products, or Services shall be resolved by binding arbitration on an individual basis.

B. Informal Resolution

You agree to attempt informal resolution for at least 30 days before initiating arbitration.

C. Arbitration Provider and Location

Arbitration shall be administered by JAMS under its consumer rules and conducted in California, unless otherwise required by law.

D. Jury Trial and Class Action Waiver

YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

E. Small Claims and Injunctive Relief

Either party may bring an individual action in small claims court or seek injunctive relief for intellectual property matters.

X. MISCELLANEOUS

B. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

C. Modifications to Terms

We may modify these Terms from time to time. Changes become effective upon posting or notice. Continued use constitutes acceptance.

D. Modifications to Services

We may modify or discontinue the Site or Services at any time without liability.

E. General Terms

These Terms constitute the entire agreement between you and us. If any provision is found invalid, the remainder shall remain in effect. You may not assign these Terms without our prior written consent.
